I have to sign an affidavit from Petco for the 3rd place prize (the photo contest that we enetered the picture of Honey Bear last week). The contract says this:

"I hereby grant Shutterfly and Petco....the right to edit and publish, use, adapt, modify, or dispose of any proper names, respective websites, in print, or any other media for advertising and promotional purposes for this and similar promotions in all media (including, without limitation, the Internet) without further compensation or permission, except where prohibited by law".

Okay...Honey Bear IS a double registered mini of only 20 months of age. We don't show but we may some day, and who knows we may breed. And this picture could be used for various applications if we chose that in the future. I have other business ventures where this photo could come in handy (we'd like to do some things with the farm around Christmas time some day, to make money).

What do ya think...is it worth a $100 gift certificate to allow them to use the photo and take away my rights to it? I'm not a professional photographer by any stretch so a photo like this is a fluke from me...not sure it could possibly be reproduced (but it very well could be, I suppose - perhaps with our next big snowfall!

).

Should I sign it, or just keep the rights to the photo?

BTW, I'm not requesting legal advice, just asking what you all would do in this position.

Well, the more I think about it the less worried I am. I don't think there'd be any Petco police visiting our holiday bazaar a year from now, checking to see if I've used the photo for flyers or whatever. ;)

The statement you put up did not say you relinquished your rights to the photo, only that you gave them permission to use it "everywhere" with no further compensation or credits.

Or did I read it wrong? Hmmmm....I'm no attorney but that's what I think. Seems like something I'd do, especially for $100

Somebody else pointed the same thing out to me, Bess...so, I think I'll go ahead and take the hundred bucks ;).
