older horses don't "grow" but the weight gain, taller hooves... could make a difference

but the trainer would know that and that in the future he could get the horse measured
 
As has been pointed out, a 'borderline' 34" horse can measure over or under on any given day. There are a lot of variables there, but any buyer should be aware (or at least made aware) that no measurement is set in stone. Although a horse should be close to it's advertised height, IMO. I think you are doing the right thing.

I just purchased a mature stallion advertised at 31.50". That's the height on his papers. When he arrived here I thought he looked taller than that. Yep, he's a whopping 33.75" tall! Barely.

Way bigger than his advertised height! I could send him back to the seller and ask for my money back, again IMO, but he's in such poor condition, I wouldn't have the heart to do that. So, I am going to fatten him up and put him back up for sale. I can't imagine that someone would be so far off on his height when he went permananet and that none of his owners 'noticed' that over the years? I am having his papers changed to reflect his true height.
 
I have agreed to give back all the money except for what it cost me to ship him back home. I deducted that. I have been sending large payments and she should have it all back soon. I have since leased him with a contract to buy starting in spring. Where he is going he will be used and well taken care of and shown....... The best thing for him.

I will have to wait on my money but, in the meantime , he will be used , driven and maybe bred a bit. The former purchaser will have to see him in the ring with someone else.

Been there, done that...twice!

The first time, the horse was advertised as being 31.5" in one place(ad), then 31.75" in another(web site). I bought him, and when he arrived, he was all of 34"!

The second time, the horse was listed on a web site at 30". I wasn't sure just how old that height listed was, so I checked the studbooks online. There, we was listed at 31.25", so in my mind, I added another 1/2" onto that for safe measure. I bought him, and when he arrived, he was all of 33"!
